A political party acquires legal personality and begins its operations on the date of its registration with the Register of Political Parties maintained by the Ministry of Public Administration and Local Self-Government under the Law on Political Parties and the Rulebook on the Method of Registration and Maintenance of the Register of Political Parties. The Register contains basic information, such as name, abbreviated name, address, founding date, personal name and unique personal identification number of the party’s representative and membership in other political associations in the country and abroad.
ESTABLISHMENT OF A POLITICAL PARTY
A political party may be established by a minimum of 10,000 – or 1,000 in case of a political party of a national minority – legal adults with the capacity to contract who are nationals of the Republic of Serbia.
A political party is established at the constituent assembly meeting by adopting its instrument of association, programme and statute and by appointing a person authorised to represent the political party.
An application for registration of a political party with the Registry of Political Parties is submitted by a person authorised to submit applications for registration with the Registry of Political Parties within 30 days of the date of establishment of the political party.
The Ministry of Public Administration and Local Self-Government must pass a decision on registration of a political party with the Register within 30 days of the date of submission of a proper application for registration. Decisions on registration of political parties with the Registry are published in the Official Gazette of the Republic of Serbia.
DUTIES OF POLITICAL PARTIES AFTER REGISTRATION
A political party is required to make publicly available online its instrument of association, the name of the person representing the political party and the programme and other general instruments of the party.
A political party must notify the Ministry of any change in the data entered in the Register within 15 days of occurrence of such change by filing an application for a change of data in the Register. If a body of a political party decides to dissolve the party or if a political party merges with one or more other political parties, the representative of that political party must file an application for deletion of the political party from the Register within 30 days of the date when the conditions for dissolution of the political party are met, with enclosed evidence to support those facts.
