PROTOCOL ON DATA EXCHANGE IN THE PROCEDURE OF APPOINTING A TEMPORARY REPRESENTATIVE IN ADMINISTRATIVE PROCEDURE SIGNED

In order to contribute to greater publicity of the work and efficiency in the procedure of appointing temporary representatives, and based on the right of the parties to legal, equal and fair protection of their rights guaranteed under the Constitution and the law, the Protocol on Data Exchange in the Procedure of Appointing a Temporary Representative in the Administrative Procedure (Protocol) was signed today between the Ministry of Public Administration and Local Self-Government, the Ministry of Justice and the Bar Association of Serbia.

The signed Protocol regulates, in more detail, the manner of submitting the request of the competent administrative body for notification of the lawyer who, in order from the list of lawyers, should be appointed as a temporary representative in the administrative procedure. Moreover, the Protocol regulates the method of notifying the bar association about the lawyer who should be appointed as a temporary representative in the order from the list of lawyers, as well as the measures of information security and personal data protection in the procedure of appointing temporary representatives in administrative procedures.

On the basis of the signed Protocol, the Bar Association of Serbia made a commitment to undertake all the necessary measures (developing a software application, establishing a call centre, forming a list of lawyers – temporary representatives according to the territorial jurisdiction of basic courts in the Republic of Serbia) and to inform the signatories of the Protocol about the exact date and time of commencement with the operation of a single call centre for the designation of temporary representatives.

The protocols were signed by the Minister of Public Administration and Local Self-Government, Aleksandar Martinović, PhD, the Minister of Justice, Maja Popović, and the Vice President of the Bar Association of Serbia, Veljko Delibašić, PhD. The Protocol entered into force on the day of its signing.
